These terms apply to your use of the ScaffControl public website (www.scaffcontrol.com.au). By using this website, you agree to them.
1. About this website
This website describes the ScaffControl software and the services we offer, and lets you contact us and download the software.
Nothing on this website is a binding offer. A contract with us is formed only by a signed Order Form under the ScaffControl Software Licence and Services Agreement, or by accepting that agreement when installing the software.
We update the website from time to time. We take reasonable care to keep it accurate, but content may not always be current.
2. Who we are
This website is operated by BR Planning Alliance Pty Ltd (ABN 22 679 284 112 / ACN 679 284 112) ("BR Planning Alliance", "we", "us", "our"), a company registered in Western Australia. ScaffControl is software developed and supplied by BR Planning Alliance Pty Ltd. It is a product name, not a separate business.
3. The ScaffControl software
ScaffControl is downloadable software that your organisation installs and runs on its own computers.
Use of the software, and of any installation, onsite, support or training services we provide, is governed by the ScaffControl Software Licence and Services Agreement, available at www.scaffcontrol.com.au/licence. These website terms do not grant any right to use the software.
If you download the software, you may install it only in accordance with that agreement.
4. Privacy
We collect personal information, such as your name and email address, when you contact us. We handle it in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and our Privacy Policy at www.scaffcontrol.com.au/privacy.html.
The Privacy Policy explains:
- what we collect;
- who we share it with, including providers outside Australia;
- how long we keep it; and
- how to access, correct or complain about your information.
This website does not use analytics, advertising or tracking cookies.
5. ScaffControl is a record-keeping tool, not a safety system
ScaffControl helps organisations keep records of scaffold requests, builds, inspections, handovers, hazards and close-outs.
It is not a substitute for:
- supervision by competent persons;
- physical inspection of scaffolds by a competent person, as required by law, Australian Standards and site procedures;
- a work health and safety (WHS) management system;
- compliance with the Work Health and Safety Act 2020 (WA) and its regulations, or equivalent laws in other jurisdictions;
- engineering design, review or certification where required; or
- the professional judgement of licensed or competent persons.
Safety duties remain with the duty holders, including site owners and operators, employers, principal contractors, scaffold contractors, persons conducting a business or undertaking (PCBUs), competent persons and workers. Recording an event in ScaffControl does not discharge any WHS duty.
6. Acceptable use of this website
You must not use this website:
- to attempt unauthorised access to our systems;
- to introduce malicious code;
- to send spam through our contact form; or
- in any way that breaks the law.
7. No warranty about the website
We provide this website for information. We do not warrant that it will be uninterrupted, error-free or free of harmful components. Download the software only from www.scaffcontrol.com.au or a link we send you directly.
Nothing in these terms excludes, restricts or modifies any right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
8. Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of this website or reliance on its general content.
This clause does not limit:
- your rights under the Australian Consumer Law; or
- anything in a signed agreement with us, which is governed by that agreement.
9. Intellectual property
The ScaffControl name, branding, website content and software are owned by or licensed to BR Planning Alliance Pty Ltd. You may view and print website content for your own evaluation. You may not otherwise copy, reproduce, publish or modify it without our written permission.
10. External links
This website may link to third-party websites for convenience. We do not control and are not responsible for their content or privacy practices.
11. Governing law and disputes
These terms are governed by the laws of Western Australia. If a dispute arises about these terms or this website, the parties must:
- first try to resolve it by good faith negotiation within 14 days after written notice of the dispute;
- if it is unresolved, refer it to mediation administered by the Resolution Institute (or another agreed body) within a further 30 days; and
- if mediation fails, either party may go to a court of competent jurisdiction in Western Australia.
Nothing in this clause prevents either party from seeking urgent injunctive relief. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
12. Changes to these terms
We may update these terms. For material changes, we will post a notice on this website at least 14 days before they take effect. Minor changes take effect when published. Changes to these website terms do not change any signed agreement.
